This Privacy Policy applies to all of the products, services and websites offered by BingeNow, Inc.
referred to in this document as BingeNow. Sometimes, we may post product specific privacy notices to
explain our products in more detail.
Type of Information Collected
We collect and use your information below to provide our Services and improve them
over time. We collect and use the information we receive about you in the following
ways.
Personal &
Business Information. BingeNow may collect and store your name, company name,
biography, postal address, email address, telephone number, home page URL, gender,
ethnicity, birthday, and any additional information you enter into your profile
(collectively, "Personal Identifying Information").
Security
Information. For many activities on our sites, you will need to create an
account. We ask for some personal and other information when you create an account,
including your email address and a password, which is used to protect your account from
unauthorized access.
Usage
Information. BingeNow may collect and store the pages you have visited and
when, the IP addresses of the computers from which you access the Site, and the URLs of
web pages that referred you to the Site. The Site uses cookies to store your identity
and session information when you log into the Site. While you can use some basic
functions of the Site without allowing these cookies, cookies are required to login and
interact with our sites, including uploading content.
Banking
Information. If we establish a financial relationship with you, we may ask you
to provide banking information, such as account and routing numbers for ACH transfers,
to be used for paying and/or debiting funds from your account. We take the security of
this information seriously and restrict access to this information to only use as
necesssary to perform agreed-upon transactions.
Uploaded Content. BingeNow may
collect and store the actual videos, images, comments, channel information and other
metadata that you have uploaded to the Site. If you email us or message us through
our services, we may keep your message, email address and contact information to
respond to your request.
Use and Disclosure of Information to Third Parties
BingeNow does not share or disclose your private personal information except in the limited
circumstances described here.
Service
Providers. We engage service providers to perform functions and provide services to
us. We may share your private personal information with such service
providers subject to obligations consistent with this Privacy Policy and any other
appropriate confidentiality and security measures, and on the condition that the third
parties use your private personal data only on our behalf and pursuant to our
instructions. We share your and your subscribers' payment Information with payment
services providers to process payments; prevent, detect and investigate fraud or other
prohibited activities; facilitate dispute resolution such as chargebacks or refunds; and
for other purposes associated with the acceptance of credit or debit cards.
Law and
Harm. Notwithstanding anything to the contrary in this Policy, we may
preserve or disclose your information if we believe that it is reasonably necessary
to comply with a law, regulation, legal process, or governmental request; to
protect the safety of any person; to address fraud, security or technical issues;
or to protect BingeNow rights or property. However, nothing in this Privacy Policy
is intended to limit any legal defenses or objections that you may have to a third
party's, including a government's, request to disclose your information.
Business
Transfers. In the event that BingeNow is involved in a
bankruptcy, merger, acquisition, reorganization or sale of assets, your information
may be sold or transferred as part of that transaction. This Privacy Policy will
apply to your information as transferred to the new entity. We may also disclose
information about you to our corporate affiliates in order to help provide,
understand, and improve our services.
Profiles. If you have a BingeNow Account,
you may update or correct your personal profile information, email preferences and
privacy settings at any time by visiting your account profile page. You may control
the information that is available to other users at any time by editing your account
information and the features that are included.
Aggregate Information.
BingeNow may use and disclose aggregate information about our visitors or
members, (collectively, "Users") to the public or to third parties, but in only
ways that do not reveal Personal Identifying Information about specific Users.
Communication.
BingeNow may also use your Personal Identifying Information to contact you
regarding issues or problems with content you have uploaded to the site, or to
occasionally notify you by email about new features or important changes to the Site
or special offers from our business partners.
Restrictions. We restrict access to
personal information to BingeNow employees, contractors and agents who need to know that
information in order to process it on our behalf. These individuals are bound by
confidentiality obligations and may be subject to discipline, including termination and
criminal prosecution, if they fail to meet these obligations.
Security
BingeNow is careful to follow the best industry-standard security
practices to ensure the safety of your Personal Identifying Information. We take
precautions including Site security, encryption and security audits to protect your
information. Despite our best efforts, however, we can not be held responsible for
any breach of security or for the actions of any person or entity other than
BingeNow.
We restrict access to personal information to BingeNow employees, contractors and
agents who need to know that information in order to process it on our behalf. These
individuals are bound by confidentiality obligations and may be subject to discipline,
including termination and criminal prosecution, if they fail to meet these
obligations.
While we will make all reasonable efforts to see that your information is used in
compliance with this Agreement, for the reason above, we cannot guarantee that all
of your Personal Identifying Information will never be disclosed in ways you do not
expect or which are not described in this Agreement.
Children
Children under the age of 13 should not provide us with any personal information
about themselves. BingeNow does not knowingly collect Personal Identifying
Information from children under the age of 13. In the event that we learn that we
have collected such information from a child under 13 without parental consent, the
information will be removed from our databases as soon as reasonably possible.
Enforcement
BingeNow regularly reviews its compliance with this Privacy Policy. When we
receive formal written complaints, it is BingeNow's policy to contact the
complaining user regarding his or her concerns. We will cooperate with the
appropriate regulatory authorities, including local data protection authorities,
to resolve any complaints regarding the transfer of personal data that cannot be
resolved between BNOTT and an individual.
Changes to the Privacy Policy
BingeNow reserves the right to modify this Agreement at any time.
